We encourage you to review this policy from time to time. “The Website” means statefairrecords.com, “User” or “You” means you being the Website end-user. By using the Website you agree to the terms of this Terms of Use. SFR reserves the right to change, modify, alter or otherwise update this Terms of Use at any time. The User’s continued use of the Website following such changes shall be deemed to be the User’s acceptance of any such change. It is the User’s responsibility to check this file regularly to determine whether this Terms of Use has been changed. If the User does not agree to any change to the Terms of Use of this Terms of Use then the User must immediately stop using the Website. 

As a general rule, no personal information (i.e. name, address, telephone number, e-mail address) is automatically collected from Users of this Website. However, there may be circumstances in which Users voluntarily supply such information and in this event, any such information will be kept secure and confidential and will be used only for those purposes made known to Users at the time the information is collected, or for the purposes specified in these Terms of Use. In the event SFR changes, modifies, alters or otherwise updates these Terms of Use from time to time SFR will not change the way we use your information provided previously without your consent.


SFR uses cookies. A cookie is a small text file that can be stored on your computer’s hard drive. It may be stored and updated at various times as you access the Website. Each time you visit the Website, the server may deliver certain customized information to your computer based on the data stored in your cookie. This allows UMPG to tailor the service to your preferences. You are not obliged to accept a cookie and you may modify your browser so that it will not accept cookies. 

We never use cookies to retrieve information from your computer which was not originally contained in the cookie. We use cookies and IP addresses for system administration and to monitor aggregate non-personalized information (such as anonymous statistics related to the take up or use of services, or to patterns of browsing). Certain non-personal information about Users is recorded by the standard operation of SFR’s internet servers. Examples of this type of information include the type of browsers being used, its operating system and the domain names (not e-mail addresses, where possible) of Users. 

Third Parties

If we include links to other internet sites on the Website or in the event we choose, in our newsletters and/or other communications, we will do so solely as a convenience to the Users. The owners of such external sites may acquire personal information and may use that information in accordance with their owner privacy policies, which are wholly unrelated to and not under the control of SFR. SFR is not responsible for or liable for the content or terms of use and practices of other websites. Your access and use of such linked sites is therefore solely at your own risk.


In the event we obtain your personal information we take reasonable precautions to protect from unauthorized access or disclosure, but we cannot act as insurers of the security of your personal information transmitted over the internet. Accordingly, we assume no liability for disclosure of data due to errors in transmission, unauthorized third-party access or other acts of third parties, or acts or omissions beyond our reasonable control.


The information, artwork, text, video, audio, pictures, software and other intellectual property (collectively, “Materials”) contained on the Website are protected by copyright and international laws. You may only access and use the Materials for personal use. You may not otherwise reproduce, distribute, publicly perform, publicly display, modify or create derivative works of the Materials (or authorize others to) for commercial gain, unless authorized by the appropriate copyright owner(s). SFR makes no representations or warranties with regard to the Website or any Materials therein, whether express or implied, arising by law or otherwise, including, without limitation, any implied warranty of merchantability, fitness for a particular purpose or non-infringement or any implied warranty arising out of course of performance, course of dealing or usage of trade.

The Website

The User acknowledges:

(a) that it is technically impossible to provide the Website free of faults and that SFR does not undertake to do so;
(b) that faults may lead to temporary unavailability of the Website; and 
(c) that the operation of the Website may be adversely affected by conditions and performances outside SFR’s control, including without limitation, transmission and telecommunications links between SFR and Users, between different parts of SFR, and between SFR and other systems and networks.


By using the Website, Materials or related services, the User agrees that, except for death and personal injury arising from the negligence of SFR, SFR shall not be liable in contract, tort, negligence, statutory duty or otherwise, for any loss or damage whatsoever arising and howsoever arising from or in any way connected with this Terms of Use or Website, including without limitation, damage for loss of business, loss of profits, business interruption, loss of business information, or any other pecuniary loss (even where SFR has been advised of the possibility of such loss or damage) whether due to inaccuracy, error, omission or any other cause.

Use of the Website

The User undertakes:

(a) that it shall not make any use of the Website such that the whole or part of the Website is interrupted, damaged, rendered less efficient, or the effectiveness or functionality of the Website is in any way impaired;
(b) not to use the Website for the transmission or posting of any computer viruses or any material which is defamatory, offensive or of an obscene or menacing character, or in such a way as to cause annoyance, inconvenience or needless anxiety;
(c) not to use the Website in a manner which constitutes a violation or infringement of any person, firm or company (including but not limited to rights of copyright or confidentiality);
(d) that it shall not use the Website to transmit any material for the purposes of publicity, promotion and/or advertising without the prior written consent of SFR; and
(e) that in the event that it has any right, claim or action against any other user arising out of the use of the Website then it shall pursue such right, claim or action independently of, and without recourse to SFR. SFR reserves the right to change any content on this Website, including but not limited to revising and/or deleting or adding features or information without prior notice to Users.


If any provision of these Terms of Use is held to be invalid or unenforceable, such provision shall be struck out and the remaining provisions shall be enforced. 

SFR’s failure to act with respect to a breach by you or others does not waive its right to act with respect to subsequent or similar breaches. Changes may be made to these Terms of Use from time to time. These Terms of Use are governed in all aspects by the Laws of the State of Texas. Legal proceedings related to the matters set out in the Terms of Use shall be brought and adjudicated solely in the courts of Texas.

Watermarked Music

The music being made available to You by SFR in connection with the Use contains a unique inaudible personalized watermark that is traceable directly to You. Any copies made of such music contain the watermark.

The music has been supplied to You for personal, non-commercial listening only, and solely in connection with the Use.  Any transfer or making available of the music to any other party, in any format whatsoever, is strictly prohibited.  It is Your responsibility to ensure that the music is kept securely and only used for purposes of the Use.  If the music has been provided to You on a digital streaming-only basis, any downloading of the music is strictly prohibited. If the music has been made available to You on a digital download-only basis, You may only transfer copies to a PC, portable player or CDR for Your personal, non-commercial listening, and solely in connection with the Use, and You are responsible for the security of the music on those devices.  You are not authorized to provide the music on those devices to any other party.  SFR retains ownership of all music provided via the Use.  No ownership whatsoever, including but not limited to copyright, is being granted to You in the music provided in the Use.  You are not authorized to create any derivative work(s) based upon the music provided in the Use.  No license whatsoever is being granted to You in connection with the music provided in the Use.  All right, title and interest, including intellectual property rights, in and to the music in the Use shall remain with SFR.  SFR reserves the right to require You to return or destroy the music provided in the Use at any time for any reason, and You agree to do so promptly on SFR request, and provide prompt written confirmation of such return or destruction.

SFR may terminate or suspend Your access to the music in the Use immediately, without prior notice or liability, for any reason whatsoever, including without limitation, Your breach of any of these Terms and Conditions, in whole or in part.  All provisions of these Terms and Conditions shall survive termination.  Upon termination, Your access to the music in the Use will cease immediately.

SFR reserves any and all rights, both in law and in equity, to take any necessary civil or criminal action against You if You breach any of these terms and conditions, in whole or in part, or any copyright law relating to the Use.  By accessing the music provided in the Use, you agree to be bound by these Terms and Conditions and accept all legal consequences.  If You do not agree to these Terms and Conditions, in whole or in part, please do not use the music in the Use for any purpose whatsoever, including but not limited to personal, commercial or non-commercial uses.   

SFR reserves the right, at its sole discretion, to modify or replace these Terms and Conditions, in whole or in part, at any time.  By continuing to access or use the music in the Use after any such revisions become effective, you agree to be bound by such revised terms.  If You do not agree to the new terms, in whole or in part, do not use the music in the Use.
